Conditions: The Sponsor reserves the right, at its sole discretion, to: disqualify any individual(s) who tamper with this offer; and/or to cancel, terminate, modify, or suspend this offer. Gift recipients individually and on behalf of their relatives, heirs, assignees, executors, and administrators, hereby permanently, irrevocably and forever waive and release any and all rights, demands, losses, liabilities, claims and causes of action whatsoever which you may now or hereafter be entitled to assert against Sponsor. All entrants must provide the following information: an email address and a regular mail address. The email address you provide will be our primary means of communication with you.
Governing Law: This offer and the rights and obligations of all participants shall be governed by and construed in accordance with the laws of the Republic of India, without effect to its principles of conflicts of law.
Dispute Resolution: All disputes, claims or demands that relate to these Offer Terms will first be brought to the attention of the other party and will be resolved individually, without resort to any form of suit or action with courts. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within sixty (60) days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within twenty-one (21) days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third-party mediator chosen by the parties. If the parties do not agree to conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Offer Terms will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Offer Terms, shall be submitted to arbitration under the Arbitration and Conciliation Act, 1996, as amended, by a sole arbitrator appointed by the Sponsor. The seat of arbitration shall be Gurgaon, India. Subject to this arbitration clause, the courts at Gurgaon, India shall have exclusive jurisdiction over any disputes occurring between the parties under these Offer Terms. Each party shall bear and pay its own costs and expenses in connection with the arbitration proceedings unless the arbitrator direct otherwise.
Severability: Should any provision of these Offer Terms be held to be void, invalid, unenforceable, or illegal by a proper legal authority, the validity and enforceability of the other provisions shall not be affected.
Data Privacy: Your personal information will be used to fulfill the terms of this Offer and may therefore be shared with Sponsor’s parent company in the United States, and/or any subcontractor, agent or partner that assists or is otherwise involved in the offer, or website operation; your information may also be used to contact you about the GMAT exam, related products and services and management education from the Sponsor, graduate business schools, scholarship-granting organizations, strategic partners and corporate affiliates of the Sponsor; and as specified in the Sponsor’s privacy policy available at http://www.mba.com/privacy/ including opt-out information. By participating / entering in the Offer, you expressly agree and permit the Sponsor to use and share your personal information in the above mentioned way.
