These Terms and Conditions (“Terms”) will provide you with information about how to participate in the EA Practice Questions (“Giveaway”). These Terms form a binding contract between the Graduate Management Admission Council® ("GMAC®") and you as a participant in the Giveaway. By participating you agree to be bound by these Terms and the decisions of Sponsor, which are final and binding with respect to the Giveaway. Sponsor: The Graduate Management Admission Council, PO Box 2969, Reston, VA 20195 United States is the “Sponsor” of the Giveaway. Term: The Giveaway will begin at 12:00 am GMT/UTC (UTC+04:00) on 20 December 2018, and end at 11:59 pm GMT/UTC (UTC+04:00) on 9 March, 2019 (the “Term”). Sponsor’s computer, or that of its designee, shall serve as the official timekeeping device for the Giveaway. Eligibility and Sponsor: To be eligible to participate in the Giveaway, as of the beginning of the Term, you must (i) be a legal resident of aforementioned countries (UNITED ARAB EMIRATES, SAUDI ARABIA, KUWAIT, QATAR, LEBANON, BAHRAIN, TURKEY). Agents and their immediate families and those living in their household, are not eligible to participate in the Giveaway. Subject to all applicable laws and regulations.
Free Gift: All eligible individuals that register for either the Executive Assessment test during the Term will receive EA Practice Questions. The approximate retail value of the free free gift is US$35. Sponsor reserves the right to substitute a gift of equal or greater value. To register for the GMAT exam:
1. Visit the applicable registration website located at http://start.mba.com/ea-prepcampaign.
2. Click on the “Register Here” button to register and successfully complete your Executive Assessment registration.
Beginning on or about December 20, 2018, gifts will be delivered to participants who fulfill the above two criteria via email. LIMIT: One (1) free gift per person. The email address you provide while submitting your details will be our primary means of communication with you. In the event of a dispute, submissions will be deemed submitted by the authorized email account holder of the email address submitted at the time of submitting details. “Authorized email account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Participants may be required to provide Sponsor with proof that he or she is the authorized account holder of the email address associated with the selected submission. Sponsor is not responsible for lost, late, misdirected, deleted, mutilated, incomplete, or illegible registration attempts; for any computer-related, online, telephonic, or technical malfunctions that may occur; or for unsuccessful efforts to contact a participant and/or send the free gift. Submissions to Sponsor are void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced or obtained through fraud or theft. Free gifts may not be transferred, assigned, or substituted by participant. All taxes, fees, duties and surcharges, if any, on the gift are the sole responsibility of the participants. If any participant declines the gift, fails to claim the gift, is unavailable for gift fulfillment, fails to abide by the Terms, or is ineligible, Sponsor reserves the right to decline to fulfill the gift with respect to such participant. If any gift delivery is refused or returned as undeliverable, that gift is forfeited.
Right to Disqualify or Modify Giveaway: Sponsor reserves the right, in its sole discretion, to: disqualify any individual(s) who tamper with the submission process; and/or to cancel, terminate, modify, or suspend the Giveaway. Sponsor reserves the right to disqualify any participant from this or any future promotion if, in its sole discretion, Sponsor reasonably believes that any person has attempted to undermine the legitimate operation of Sponsor or the Giveaway by cheating, deception, or other unfair practices, or has tampered with any of Sponsor’s websites, the registration process, violates these Terms, or acts in an unsportsmanlike or disruptive manner, or annoys, abuses, threatens, or harasses Sponsor, its agents, its assigns or any other participant.
Limitation of Liability: TO THE EXTENT LEGALLY PERMISSIBLE, PARTICIPANTS INDIVIDUALLY AND ON BEHALF OF THEIR RELATIVES, HEIRS, ASSIGNEES, EXECUTORS, AND ADMINISTRATORS, HEREBY PERMANENTLY, IRREVOCABLY AND FOREVER WAIVE AND RELEASE ANY AND ALL RIGHTS, DEMANDS, LOSSES, LIABILITIES, CLAIMS AND CAUSES OF ACTION WHATSOEVER WHICH YOU MAY NOW OR HEREAFTER BE ENTITLED TO ASSERT AGAINST SPONSOR, ITS RESPECTIVE AFFILIATES, PARENT, AND SUBSIDIARY COMPANIES, EMPLOYEES, AGENTS AND OFFICERS, ADVERTISING, MARKETING AND PROMOTION AGENCIES, AS WELL AS ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF THE GIVEAWAY (COLLECTIVELY, THE “RELEASED PARTIES”), INCLUDING, BUT NOT LIMITED TO ANY DEATH, INJURY, LOSS OF ENJOYMENT OR OTHER HARM OR LOSS OF ANY NATURE WHATSOEVER CAUSED BY, CONTRIBUTED TO, OR ARISING OUT OF THE GIVEAWAY AND/OR ANY GIFT PROVIDED, ANY CLAIM OR DEMAND FOR ADDITIONAL COMPENSATION OR ANY OTHER CLAIM OR DEMAND RELATED TO THE GIVEAWAY OR WHAT THE SPONSOR PROVIDES, AND FOREVER RELEASE AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY WITH RESPECT THERETO. THE RELEASED PARTIES ASSUME NO RESPONSIBILITY FOR ANY ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, OR DELAY IN OPERATION OR TRANSMISSION; COMMUNICATIONS LINE FAILURE; THEFT OR DESTRUCTION OF OR UNAUTHORIZED ACCESS TO GIVEAWAY SUBMISSIONS OR ENTRY FORMS; OR ALTERATION OF SUBMISSIONS OR ENTRY FORMS.
Giveaway Conditions: By accepting a prize, recipients agree: (a) to be bound by these Terms and any other documents required by Sponsor herein and by the decisions of the Sponsor, and to waive any right to claim ambiguity in this Giveaway, the Terms or any other documents required by Sponsor herein, (b) to indemnify, defend and hold harmless the Released Parties from and against any and all liability, claims, losses, damages, demands, causes of action, penalties and expenses arising out of or related to any statement, action or failure to act by recipient during or in connection with his/her participation herein and/or any breach or alleged breach of these Terms or of any other documents required by Sponsor and, (c) not to sue and to hereby irrevocably and unconditionally release, discharge and hold harmless the Released Parties from any and all liabilities, claims and demands of any kind or nature whatsoever, in law or equity, whether known or unknown, which recipient (or recipient’s successors-in-interest, heirs and/or agents) ever had, now have, or in the future may have against the Released Parties, including, but not limited to claims arising out of or related to personal injury (including death) and/or damage, theft, loss or any other harm resulting in whole or in part, directly or indirectly, from (i) participation in the Giveaway or any Giveaway related activity, (ii) the acceptance, possession, misuse or use of the prize, (iii) the use of any of the rights granted herein, (iv) any malfunction or other problem with any Giveaway website or web page, (v) any error in the collection or retention of entry information, and (vi) any typographical or other error in the printing, offering or delivery of any free gift.
Governing Law: This offer and the rights and obligations of all participants shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA, without effect to any principles of conflicts of law, and the federal law of the United States. Data Privacy: Your personal information will be used to fulfill the terms of this offer and may therefore be shared with Sponsor’s parent company in the United States, and/or any subcontractor, agent or partner that assists or is otherwise involved in the offer, or website operation. By participating in the Giveaway, you agree to the transfer of your personal information to the United States, where Sponsor’s parent company and its data processors are located.
