BINDING AGREEMENT: These Participation Terms (“Terms ”) will provide you with information about how to participate in the GMAT Exam – The Friendlier Exam Special Offer Giveaway (“Giveawy”). These Terms form a binding contract between the Graduate Management Admission Council ("GMAC") and you as a participant in the Giveaway. By entering you agree to be bound by these Terms. If you breach a provision of these Terms, you will forfeit your free gift. If you have questions, please contact GMAC at india@gmac.com.
ELIGIBILITY: To participate in the Giveaway, you must be (i) above the age of majority in the jurisdiction in which you reside at the time of your submission; and (ii) you must be a resident of India. Current employees, directors, and officers of GMAC, their affiliates, agents and their immediate families and those living in their household, are not eligible to participate in the Giveaway. All federal, state, and local laws and regulations apply. VOID OUTSIDE OF INDIA AND WHERE PROHIBITED OR RESTRICTED BY LAW.
SPONSOR: Graduate Management Admission Council India Private Ltd, 303, Suncity Business Towers, Golf Course Road, Sector 54 Gurgaon, Pin code - 122002, Haryana, India, is the sponsor of the Giveaway (“Sponsor” or “GMAC”).
GIVEAWAY PERIOD: The Giveaway will begin at 12:00.01 am India Standard Time (IST) on 25th January, 2017, and ends at 11:59pm IST on 25th April, 2017 ( “Giveaway Period")
HOW TO PARTICIPATE:

- Register for the GMAT® exam on mba.com within the Giveaway period
All eligible persons who successfully register for the GMAT exam during the Giveaway Period will be eligible to receive the Amazon Voucher
LIMIT: One (1) Amazon Voucher worth INR 3000 per eligible person. Sponsor reserves the right to substitute the free gift with a different gift with the same or greater value. The email address you provide while submitting your details will be our primary means of communication with the participant. All submissions must be submitted in English. Once you submit your registration details, no further changes can be made to the details.
Sponsor is not responsible for lost, late, misdirected, deleted, mutilated, incomplete, or illegible submissions, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Submissions are void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced or obtained through fraud or theft.
In the event of a dispute, submissions will be deemed submitted by the authorized email account holder of the email address submitted at the time of submitting details. “Authorized email account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Participants may be required to provide Sponsor with proof that he or she is the authorized account holder of the email address associated with the selected submission.
ELECTRONIC COMMUNICATIONS: By submitting your details, you agree to communicate for the purpose of this offer with Sponsor electronically. By agreeing to do business electronically, you (i) agree that your consent to these Terms is a binding form of your electronic signature, which you agree binds you to these Terms, (ii) represent that you have Internet access and a valid email address enabling you to receive communications and documents electronically, and (iii) represent that you have a printer or other device to print or otherwise save communications and documents include without limitation, these Terms and that you have, in fact, printed or otherwise saved a copy of these Terms for your records. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents, update your contact information, or request a free paper copy of these Terms at any time by contacting us as set forth in these Terms. We will send you a confirmation notice once we have processed your change request.
FREE GIFT: Every eligible person who successfully registers for the GMAT exam as described above will be eligible to receive one (1) Amazon voucher worth INR 3,000 after completion of the activity. Sponsor reserves the right to substitute the free gift with a different gift with the same or greater value. Chance plays no role in the selection of gift recipients.
Sponsor and its affiliates, subsidiaries, employees, agents, officers and directors, advertising and marketing agencies, and their respective officers, directors, employees, and their respective agents will not be liable for unsuccessful efforts to notify a participant and/or send the free gift. No prize transfer, assignment, or substitution by participants is permitted. All federal, state, and local taxes, fees, duties and surcharges, if any, on the gift are the sole responsibility of the participants. If any participant declines the gift, fails to claim the gift, is unavailable for gift fulfilment, fails to abide by the Terms, or is ineligible, Sponsor reserves the right to decline to fulfil the gift with respect to such participant. If any gift delivery is refused or returned as undeliverable, that gift is forfeited.
LIMITATION OF LIABILITY: Participants individually and on behalf of their relatives, heirs, assignees, executors, and administrators, hereby permanently, irrevocably and forever waive and release any and all rights, demands, losses, liabilities, claims and causes of action whatsoever which you may now or hereafter be entitled to assert against Sponsor, their respective affiliates, parent, and subsidiary companies, employees, agents and officers, advertising, service providers, marketing and promotion agencies, as well as all others associated with the development and execution of the Giveaway (collectively, the “Released Parties”), including, but not limited to any death, injury, loss of enjoyment or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of the Giveaway and/or any gift provided, any claim or demand for additional compensation or any other claim or demand related to the Giveaway or what the Sponsor provides, and forever release and discharge the Released Parties from any and all liability with respect thereto. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Giveaway submissions or entry forms; or alteration of submissions or entry forms.
CONDITIONS: Participants agree (a) to be bound by these Terms; (b) to the transfer of your personal information to the United States, where GMAC and its data processors are located, and the use of your information by GMAC (India and corporate affiliates); and (c) that all submitted information becomes the property of GMAC and will not be acknowledged or returned. GMAC is not responsible for: (i) lost, late, incomplete, invalid, illegible, deleted, or misdirected submissions, which will be disqualified; (ii) for failed, partial or garbled computer transmissions; (iii) for technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; or (iv) for any error, technical or otherwise. GMAC reserves the right, in its sole discretion, to disqualify any participant not in compliance with these Terms.
You acknowledge and agree that GMAC may keep your submission indefinitely and disclose it for any purpose, including but not limited to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims that any submission violates the rights of third-parties; or (d) without undertaking a duty to do so, protect the rights, property, or personal safety, of our users and the public.
RIGHT TO DISQUALIFY, MODIFY, CANCEL OR SUSPEND: GMAC reserves the right, at its sole discretion, to: disqualify any individual(s) who tamper with the submission process; and/or to cancel, terminate, modify, or suspend the Giveaway. GMAC reserves the right to disqualify any participant from this or any future promotion if, in its sole discretion, GMAC reasonably believes that any person has attempted to undermine the legitimate operation of GMAC or the promotion website by cheating, deception, or other unfair practices, or has tampered with any of GMAC's websites, the submission process, violates these Terms, or acts in an unsportsmanlike or disruptive manner, or annoys, abuses, threatens, or harasses GMAC, its agents, its assigns or any other participant.
PUBLICITY: Acceptance of any gift related to this Giveaway constitutes permission for, and participants’ consent to, GMAC and its agencies or assigns to use the submission and the names, country of residence and/or likenesses of any participant for advertising and promotional purposes, in any media now or hereafter known, without further notice, compensation, consideration, review, or consent, except as prohibited by law.
GOVERNING LAW: The Giveaway and the rights and obligations of all participants and submissions shall be governed by and construed in accordance with the laws of Delhi, India without effect to any principles of conflicts of law, and the law of India. Should any provision of these Terms be held to be void, invalid, unenforceable, or illegal by a proper legal authority, the validity and enforceability of the other provisions shall not be affected.
ARBITRATION: By participating in the Giveaway, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Giveaway will be decided by binding arbitration. All disputes between you and GMAC of any kind or nature arising out of these Terms or your participation in the Giveaway, shall be submitted to Judicial Arbitration and Mediation Services, Inc. (“JAMS”) for binding arbitration under its rules then in effect in the Washington, DC USA area and to be conducted in Washington, DC before one arbitrator to be mutually agreed upon by both parties.
DATA PRIVACY: Your personal information will be used to fulfil the terms of this Giveaway and may therefore be shared with any service provider, subcontractor, agent or partner that assists or is otherwise involved in the Giveaway or website operation as specified in GMAC's privacy statement available at www.gmac.com/privacy. You can opt-out from receiving this information at any time by contacting privacy@gmac.com. By entering this Giveaway, you agree to the GMAC privacy statement located at www.gmac.com/privacy.
